Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”) and APKOR d.o.o., a company incorporated under the laws of the Republic of Croatia, with its registered office at Milana Frlana 24A, Matulji, Croatia, owner of the MONDISH platform (“Mondish”, “we”, “us”, or “our”).

These Terms govern your access to and use of Mondish’s mobile applications, websites, APIs, and related services (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Eligibility and Acceptance

You may access and use the Services if you are at least 16 years of age. Certain content available through the Services may relate to substances or activities that are subject to age restrictions under applicable laws, including but not limited to alcohol, tobacco, or similar regulated products.

By accessing or using such content, you represent and warrant that you meet the minimum legal age and all other legal requirements applicable in your jurisdiction. You acknowledge that it is your sole responsibility to ensure compliance with all applicable laws and regulations relating to access, viewing, or use of such content.

If you are under the age of majority in your jurisdiction, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

If you access or use the Services on behalf of a legal entity, you represent and warrant that you have full authority to bind such entity to these Terms.

2. Nature of the Services

Mondish is a digital platform that provides users with curated and original content in the fields of gastronomy, travel, and culture, including interactive and entertainment-oriented formats. Content made available through the Services is primarily created and curated by Mondish and is designed to inform and entertain users, including through the presentation of culinary specialties from various countries and cities. A key functionality of the Services includes interactive elements, gameplay, and similar gamification mechanisms through which users are guided across different destinations and their gastronomic characteristics.

Users may have access to limited interaction functionalities within the Services; however, such interaction does not constitute the publication or distribution of content in a public sense. Mondish reserves the right, at its sole discretion, to modify, expand, or adapt the functionalities, structure, or content of the Services at any time.

Certain features or content within the Services may be made available for a fee or on a subscription basis. Access to such paid content is subject to these Terms and any additional terms presented at the time of purchase.

3. User Accounts

To access certain features of the Services, you are required to create a user account (“Account”). In the course of registration and use of the Services, you will be required to provide certain personal data, which may include, but is not limited to, your username, email address, password, device information, and any additional information you voluntarily submit (collectively, “Account Data”). Upon successful registration, a unique user identification number may be assigned to your Account for the purpose of identification and internal system management.

You must promptly notify Mondish if you suspect any unauthorized access to or use of your Account.

The processing of your Account Data is necessary for the performance of the contract between you and Mondish, in accordance with the EU General Data Protection Regulation. Further details regarding the collection, use, and protection of your personal data are set out in our Privacy Policy.

You agree to:

  • Provide accurate, current, and complete Account Data;
  • Keep your Account Data updated at all times;
  • Maintain the confidentiality and security of your login credentials;
  • Be solely responsible for all activities that occur under your Account.

Mondish shall not be liable for any loss or damage arising from unauthorized use of your Account. We reserve the right, at our sole discretion and without prior notice, to suspend or terminate your Account, restrict access to the Services, or remove any content associated with your Account in the event of a breach of these Terms or where required to comply with applicable law.

4. License to Use the Services

Subject to your full, ongoing, and strict compliance with these Terms, Mondish grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Services solely for your own personal, non-commercial use. This license does not confer any ownership rights and may be withdrawn at any time at Mondish’s sole discretion. All rights not expressly granted to you are expressly reserved by Mondish.

Except to the extent expressly permitted by mandatory provisions of applicable law, you shall not, directly or indirectly:

  • copy, reproduce, distribute, publicly communicate, or otherwise make available the Services or any part thereof;
  • modify, adapt, translate, or create derivative works based on the Services;
  • reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, underlying structure, or algorithms of the Services;
  • access or use the Services for the purpose of developing, training, or supporting any competing product or service, including any competing platform, database, or machine learning system;
  • use the Services for any commercial purpose, including advertising, solicitation, or monetization, without Mondish’s prior written consent;
  • remove, alter, or obscure any proprietary notices, trademarks, or branding;
  • circumvent, disable, or otherwise interfere with security-related features or technical measures of the Services;
  • access, scrape, extract, or harvest data from the Services by automated or non-automated means, except as expressly authorized by Mondish.

Any use of the Services in violation of these Terms shall result in the immediate termination of the license granted herein and may give rise to further legal action.

5. User Inputs and Submitted Materials

5.1 Ownership

You retain ownership of any data, materials, or information you provide through the Services (“User Inputs”).

5.2 License to Mondish

By submitting User Inputs, you grant Mondish a non-exclusive, worldwide, royalty-free license to use, store, and process such User Inputs solely for the purpose of operating, improving, and maintaining the Services, including analytics and personalization. Where necessary for these purposes, User Inputs may be shared with Mondish’s affiliates and service providers. This license does not grant Mondish the right to make User Inputs publicly available, except where this is a functional part of the Services. Nothing in this section affects your rights under applicable data protection laws.

5.3 Responsibility

You are responsible for your User Inputs and confirm that you have the right to provide them and that they do not violate applicable laws or third-party rights. Mondish may remove or restrict User Inputs where reasonably necessary to ensure compliance with these Terms or applicable law.

6. Acceptable Use and Restrictions

By accessing and using the Services, you agree to comply with these Terms, Mondish’s internal rules as made available within the Services or through separate policies (“Mondish Standards”), and all applicable laws and regulations.

You shall not, directly or indirectly use the Services in any manner that is unlawful, misleading, fraudulent, or otherwise harmful; input, submit, or otherwise use data or materials that infringe the intellectual property, privacy, or other rights of any third party; use the Services for harassment, threats, discrimination, or any abusive or disruptive conduct; input, submit, or otherwise use inaccurate, misleading, or harmful information, particularly in relation to health, food safety, or regulated substances; introduce malicious code, viruses, or other harmful elements, or attempt to gain unauthorized access to Mondish’s systems or data; use the Services in any manner that interferes with, disrupts, or undermines the functionality, security, or integrity of the Services, including attempts to circumvent technical or security measures; use the Services for activities that violate laws applicable to regulated products or content, including alcohol, tobacco, or similar substances; use the Services for unauthorized data collection, automated access, scraping, or similar activities, except as expressly authorized by Mondish.

Mondish reserves the right, at its sole discretion and where reasonably necessary, to monitor the use of the Services and to take appropriate measures to protect the integrity, security, and lawful operation of the Services. Such measures may include restricting functionalities, removing or disregarding User Inputs, temporarily suspending or permanently terminating user accounts.

Mondish may also take appropriate legal or technical measures, including cooperation with competent authorities, where necessary to prevent misuse, protect rights, or ensure compliance with applicable law.

7. Disclaimer

The Services may include recipes, nutritional information, data on dietary preferences, allergen-related information, and other content related to food, travel, and culture, and are provided solely for informational, educational, and entertainment purposes.

Mondish makes reasonable efforts to ensure the quality and accuracy of the content; however, it does not guarantee its completeness, accuracy, timeliness, or suitability for any particular purpose.

To the fullest extent permitted by applicable law, Mondish expressly disclaims any liability arising out of or in connection with allergic reactions, intolerances, or individual dietary responses; foodborne illnesses, contamination, or improper food preparation; inaccurate, incomplete, or potentially unsafe preparation or consumption instructions; and/or any nutritional, dietary, or health-related statements or information made available through the Services.

All content made available through the Services does not constitute medical, dietary, or any other professional advice. You are responsible for independently verifying all relevant information, including ingredients, allergens, preparation methods, and suitability for your personal circumstances. You agree that you do not rely solely on any content made available through the Services.

In the course of using the Services, you may voluntarily provide information regarding your dietary preferences, allergies, intolerances, or religious or philosophical beliefs that may be inferred from your dietary habits or restrictions. Such information may constitute special categories of personal data within the meaning of the GDPR, and by submitting such information, you provide your explicit consent to its processing for the purpose of providing and personalizing the Services.

The provision of such data is entirely voluntary. You may withdraw your consent at any time in accordance with applicable law and as further described in the Privacy Policy. In the event of withdrawal of consent, Mondish will delete or anonymize all data based on such consent, including where such deletion is necessary to comply with legal obligations or for the continued operation of the Services.

8. Third-Party Content and Advertising

The Services may include links to third-party websites, applications, content, or services, as well as advertisements and promotional materials provided by third parties (“Third-Party Content”). Such Third-Party Content is not owned or controlled by Mondish, and Mondish does not endorse, verify, or assume any responsibility for its accuracy, legality, or reliability. Your access to and use of Third-Party Content is at your own risk, and you are encouraged to review the applicable terms and privacy policies of such third parties.

In connection with the operation and monetization of the Services, Mondish and its partners may use cookies, software development kits (SDKs), pixels, device identifiers, and similar tracking technologies (“Tracking Technologies”) within the application and related services. These Tracking Technologies may be used to enable core functionality of the Services; personalize content, recommendations, and user experience; deliver targeted advertising and sponsored content; measure performance, analytics, and user engagement; and/or prevent fraud, abuse, and ensure platform security.

Such Tracking Technologies may collect or process information including, but not limited to, device identifiers, IP addresses, browser or device characteristics, usage data, interaction data, and approximate location data.

Where required by applicable law, including GDPR and relevant ePrivacy rules, Mondish will obtain your consent prior to the use of non-essential Tracking Technologies. You may manage your preferences or withdraw consent at any time through the settings made available within the Services or your device.

Mondish does not control third-party tracking technologies and shall not be responsible for any data collection, processing, or practices of third parties. Any interactions you have with third-party advertisers or services are solely between you and such third parties.

To the fullest extent permitted by law, Mondish disclaims any liability for any loss or damage arising from your interaction with Third-Party Content or the use of Tracking Technologies operated by third parties.

9. Intellectual Property

All rights, title, and interest in and to the Services, including but not limited to all software, source code, gamification mechanics, narrative structure, visual/game assets, quiz / challenge logic, databases, algorithms, user interfaces, designs, layouts, audiovisual elements, trademarks, trade names, logos, branding, recipes, and any other materials or content made available by Mondish (collectively, the “Mondish Materials”), are and shall remain the exclusive property of Mondish or its licensors.

The Mondish Materials are protected by applicable copyright, trademark, database, and other intellectual property laws, as well as unfair competition laws.

Except as expressly permitted under these Terms or required by mandatory provisions of applicable law, no part of the Mondish Materials may be copied, reproduced, distributed, modified, adapted, displayed, performed, transmitted, or otherwise used in any form or by any means without the prior written consent of Mondish.

You are not granted any rights, licenses, or interests in or to the Mondish Materials other than the limited right to access and use the Services in accordance with these Terms. Any unauthorized use of the Mondish Materials may result in the immediate suspension or termination of your access to the Services and may give rise to civil and/or criminal liability.

10. Intellectual Property Infringement and Takedown

Mondish respects the intellectual property rights of third parties and expects users of the Services to do the same.

If you believe that any content made available through the Services infringes your intellectual property rights, you may submit a request for the removal of or restriction of access to such content in accordance with applicable law. Mondish will review and process such requests within a reasonable time frame and in accordance with relevant legal standards.

Such a request should include sufficient information to enable Mondish to identify the content in question, verify the claimant’s rights, and assess the validity of the request. Mondish reserves the right to request additional information where necessary for the processing of the request.

Mondish may, at its sole discretion and where reasonably necessary, remove, restrict, or disable access to any content that it considers to infringe intellectual property rights or otherwise violate these Terms or applicable law.

Mondish further reserves the right to take appropriate measures with respect to user accounts in cases of misuse of the Services, including where a user submits materials or data that infringe the rights of third parties. Such measures may include warnings, restriction of functionalities, temporary suspension, or permanent termination of accounts.

Where applicable, Mondish may provide the affected party with an opportunity to respond to a request or to contest the measures taken, in accordance with applicable legal requirements. Mondish further reserves the right to cooperate with competent authorities and disclose relevant information where necessary to ensure compliance with applicable law.

11. Privacy and Data Protection

Your use of the Services is subject to our Privacy Policy, which forms an integral part of these Terms. Mondish processes personal data in accordance with applicable data protection laws, including GDPR.

12. Paid Services

Certain features of the Services, including enhanced functionalities, access to interactive content, and additional features (“Paid Services”), may be made available to users for a fee. Mondish may, at its sole discretion, offer promotional access to Paid Services under specific conditions and for a limited period.

Paid Services are available on a subscription basis as follows:

Founding members are defined as all users who subscribed to a mondish Plus or mondish Premium plan within the first year following the official app launch. Founding member pricing will remain fixed for five years from the date of subscription. Founding member pricing applies solely to the specific plan tier subscribed to during the founding member period.

All prices are stated in euros (EUR) and are inclusive or exclusive of value added tax (VAT), as indicated at the time of purchase and in accordance with applicable law.

Payments shall be made through the payment methods made available within the Services, which may include third-party payment service providers or application marketplace providers (e.g., app stores). By purchasing Paid Services, you agree to comply with the applicable terms of such third parties.

Subscriptions renew automatically for successive billing periods unless cancelled prior to the end of the current billing cycle. You may cancel your subscription at any time through your account settings or the relevant payment provider.

Unless required by applicable law or where termination is not the result of your breach of these Terms, fees already paid are non-refundable.

Mondish reserves the right to modify pricing, subscription terms, or features of the Paid Services at any time, with reasonable prior notice where required by applicable law.

Additional terms or policies may be presented to you at the time of purchase or when accessing specific Paid Services (“Additional Terms”). Such Additional Terms shall supplement and form an integral part of these Terms. In the event of any conflict, the Additional Terms shall prevail with respect to the relevant Paid Services.

If you are a consumer residing in the European Union, you may have a statutory right to withdraw from the purchase of Paid Services within fourteen (14) days from the date of conclusion of the contract, without giving any reason.

However, where the Paid Services consist of digital content or services made available immediately upon purchase, you expressly acknowledge and agree that performance of the Paid Services may begin immediately upon activation, and that you thereby lose your right of withdrawal once the service has been fully performed.

Where the Paid Services have been partially performed at the time of withdrawal, Mondish reserves the right to charge a proportionate amount for the services provided up to the point of withdrawal, to the extent permitted by applicable law.

Where purchases are made through a third-party app store, the billing, cancellation, and refund rules of that provider may also apply.

13. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Mondish, its affiliates, and their respective directors, officers, employees, contractors, agents, licensors, and service providers (collectively, the “Mondish Entities”) from and against any and all claims, demands, actions, proceedings, damages, losses, liabilities, costs, and expenses (including reasonable legal fees and expenses) arising out of or in connection with your access to or use of the Services; your breach or alleged breach of these Terms or applicable laws and regulations; any data, information, or materials that you input, submit, or otherwise make available through the Services, including any allegation that such materials infringe the rights of any third party; your misuse of the Services, including use contrary to their intended purpose or functionalities; and/or any unauthorized use of your account or activities conducted through it.

Mondish reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to fully cooperate with Mondish in connection with such defense.

14. Limitation of Liability

To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory. Mondish expressly disclaims all warranties, including, without limitation, any implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, security, accuracy, or reliability of the Services or any content made available therein.

Mondish does not warrant that the Services will be uninterrupted, error-free, secure, or free from viruses or other harmful components, nor that any defects will be corrected.

Mondish shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including, without limitation, loss of profits, loss of data, loss of goodwill, business interruption, or other intangible losses, arising out of or in connection with your access to or use of, or inability to access or use, the Services, even if Mondish has been advised of the possibility of such damages.

Nothing in these Terms shall exclude or limit liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or any other liability that must be borne under mandatory legal provisions.

15. Modification of the Services

Mondish reserves the right, at its sole discretion and without prior notice, to modify, update, suspend, restrict, or discontinue, in whole or in part, any aspect of the Services, including features, functionalities, content, or availability, at any time.

To the fullest extent permitted by applicable law, Mondish shall not be liable for any loss, damage, or inconvenience arising out of or in connection with any such modification, suspension, or discontinuation of the Services.

16. Termination

Mondish may, suspend, restrict, or terminate your access to the Services, in whole or in part, at any time and for any reason, including, without limitation, in the event of a breach of these Terms or where required for legal or operational reasons.

You may terminate your use of the Services at any time by deleting your Account and discontinuing use of the Services.

Where Mondish terminates your Account due to your breach of these Terms or unlawful conduct, you shall not be entitled to any refund of fees already paid, and any remaining portion of the subscription period shall be forfeited.

Where you terminate your Account, Mondish shall be entitled to retain the remainder of the subscription fees.

17. Changes to These Terms

Mondish reserves the right to amend or update these Terms from time to time at its sole discretion. Where required by applicable law, we will provide reasonable notice of any material changes, including by making the updated Terms available through the Services or by other appropriate means.

Your continued access to or use of the Services after the effective date of the updated Terms constitutes your acceptance of such changes. If you do not agree to the revised Terms, you must discontinue use of the Services prior to their effective date.

18. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Croatia, without regard to its conflict of law principles.

Any disputes arising out of or in connection with these Terms or the use of the Services shall be subject to the exclusive jurisdiction of the competent courts at the registered seat of Mondish.

19. Digital Services Act Compliance

Mondish provides digital Services that include curated and original content, as well as limited user interaction functionalities. To the extent applicable, Mondish operates in compliance with the relevant legal framework of the European Union, including Regulation (EU) 2022/2065 (the “Digital Services Act”).

Mondish has no general obligation to monitor content or information made available through the Services or to actively seek facts or circumstances indicating illegal activity, except to the extent required by applicable law. Notwithstanding the foregoing, Mondish may establish mechanisms through which users or third parties may notify Mondish of content or information available through the Services that they consider to be unlawful or in breach of these Terms (a “Notice”).

Such Notices should contain sufficient information to enable Mondish to understand the nature of the alleged infringement and to identify the relevant content or functionality of the Services. Mondish reserves the right to request additional information where necessary to process a Notice.

Mondish will, within a reasonable time frame and in accordance with the nature of the Services, assess received Notices and, where appropriate, take suitable measures, which may include restricting the availability of certain content, functionalities, or data, or taking action with respect to user accounts, in accordance with these Terms and applicable law.

Where required by applicable law, Mondish may inform the reporting party of the actions taken. Mondish may also, where applicable, provide affected users with the opportunity to request a review of certain measures, and such review shall not be based solely on automated processing.

Mondish reserves the right to take appropriate measures in cases of misuse of the Services or reporting mechanisms, including restricting functionalities, suspending, or terminating user accounts.

Mondish may cooperate with competent authorities and comply with lawful orders relating to the removal of or restriction of access to certain content or information, as well as requests for the provision of data, in accordance with applicable law. Mondish designates a single point of contact for communication with users and competent authorities regarding matters related to these Terms and applicable law. Nothing in this Section shall be interpreted as imposing a general obligation on Mondish to monitor content or information made available through the Services or to actively seek illegal activities.

20. Availability of the Services

The Services are intended for use in jurisdictions where such use is lawful. Mondish makes no representation that the Services, or any part thereof, are appropriate or available for use in all jurisdictions.

Access to the Services from territories where their content or use is illegal is prohibited. Users are responsible for ensuring that their use of the Services complies with all applicable local laws and regulations.

21. Assignment

You may not assign, transfer, or otherwise dispose of any of your rights or obligations under these Terms without the prior written consent of Mondish.

Mondish may assign or transfer its rights and obligations under these Terms, in whole or in part, to any affiliate or in connection with a merger, acquisition, reorganization, or sale of assets, without restriction and without prior notice, subject to applicable law.

22. Miscellaneous

Mondish shall not be liable for any failure or delay in the performance of its obligations under these Terms where such failure or delay results from events beyond its reasonable control, including, without limitation, natural disasters, acts of government, war, terrorism, civil unrest, labor disputes, power outages, failures of telecommunications networks, internet service disruptions, or failures of third-party service providers, hosting infrastructure, or technical systems.

The provisions of these Terms which by their nature should survive termination shall remain in force, including, without limitation, Section 5 (User Inputs and Submitted Materials), Section 9 (Intellectual Property), Section 13 (Indemnification), Section 14 (Limitation of Liability), as well as any other provisions which by their nature are intended to survive termination.

Nothing in these Terms shall be deemed to create any partnership, joint venture, employment, agency, or fiduciary relationship between you and Mondish. You are not authorized to bind Mondish in any manner.

If any provision of these Terms is held by a competent court to be invalid, illegal, or unenforceable, such provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

Mondish’s failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver shall be effective only if made in writing and shall apply solely to the specific instance for which it is given.
